Terms and conditions of Ticket Purchase for: – Port Venture & Junk Cruises
By purchase of tickets from these companies you acknowledge the following:

  • The person who makes the booking recorded on the boarding pass / manifest-
    1. is deemed to have entered into this contract on behalf of each person named in the booking and/or whom the person making the booking is traveling with and responsible.
    2. Warrants that he accepts these conditions and gives the undertakings referred to below for each person.
  • In these terms and conditions “carriage” means the voyage or intended voyage shown on this ticket and includes entering the premises occupied or controlled by the company, embarkation and/ or disembarkation and at all times on board the vessel.
  • Each right, immunity and limitation of liability in these conditions continues in full force and effect in all circumstances and notwithstanding any breach of this contract by the company.
  • Shall not be held liable for death, personal injury, loss or damage to property howsoever arising and therefore by signing this booking form, you hereby release, to the full extent permitted by state, law and equity, The Company, its’ employees and agents from all actual and contingent liability in respect of such personal injury, death, loss or damage. Whatsoever and howsoever arising (including but not limited to indirect or consequential losses) as a result of, or in any way connected with the carriage.
  • Where equipment, products, services, facilities or assistance of any kind are supplied by any third party, the company has no responsibility or liability of any kind in connection with them.
  • The company reserves the right in its sole discretion, to:-
    1. Substitute any vessel other than the one designated for the voyage
    2. Cancel, Abandon or alter any advertised sailings or route at any time if the Master of the vessel consider in their sole discretion that such is advisable in the interests of safety of the vessel and persons; and
    3. In the event of such substitution, cancellation, abandonment, alteration or deviation the company will not be liable for any resulting costs or consequences of any kind.
  • The company retains the right to refuse to carry or refuse access to the vessel to any person or thing at its discretion.
  • Passengers may not discard any item of rubbish of any kind overboard the vessel. The passenger agrees to indemnify the company for any loss or penalty incurred by company as a result of the discard of rubbish overboard the vessel by the passenger or as a result of the passenger’s conduct.
  • The passenger(S) agrees for himself/herself and on behalf of each person that they have booked for, that they will-
    • follow reasonable direction of the company’s representatives concerning access or use of the facilities, the consumption of alcohol, the supervision of minors and the safety and comfort and enjoyment of other passengers.
    • that if any medical assistance is provided during carriage it is at the passengers sole risk.
    • To be responsible for safe custody of personal items and accompanying baggage.
    • That they will not endanger their own health or safety.
  • The Passenger agrees to take directions from any representative of the company in relation to the Health and Safety of the passenger or other passengers. The passenger agrees to indemnify the company for any loss the company may suffer that stems from the failure of the passenger to comply with a reasonable direction.
  • The company reserves its right to limit its liability pursuant to the LIMITATION OF LIABILITY FOR MARITIME CLAIMS ACT 1989.
  • The law that governs these terms and conditions is the law of New South Wales. The passenger agrees that any dispute between the passenger and the company will be heard in the courts of New South Wales.
